D. Scott Barber
Attorney Mr. Barber practices both real estate and elder abuse litigation.
Real Estate Litigation
Mr. Barber specializes in commercial real estate litigation including unlawful detainers, CAM disputes, defense of ADA claims/lawsuits, purchase/sale problems and other lease and possession-related issues. Mr. Barber is the third-generation of his family to be involved in real estate in San Diego. His grandfather, R.K. Smith, was one of La Jolla’s first real estate brokers while his mother remains a licensed broker. Mr. Barber developed an early interest in real estate law as evidenced by his receiving the American Jurisprudence (highest grade) award for Property Law during his first year in law school. Since passing the bar, Mr. Barber has represented both small and large property management companies in disputes throughout California, and is a member of ICSC.
Elder Abuse
While at his previous firm, Gordon & Rees LLP, Mr. Barber defended two of the largest privately-owned nursing home chains in the United States and California from elder abuse claims. As a result, Mr. Barber brings a unique perspective to the prosecution of elder abuse claims as he has an insider’s perspective on how such facilities and companies work. Prior to Gordon & Rees, Mr. Barber defended physicians in medical malpractice cases and achieved several defense verdicts at trial. Mr. Barber’s interest in the rights and protection of elders also developed early in his legal education as his law review article explored the extensive 1991 revisions to the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA).
Mr. Barber was born and raised in San Diego. He received his B.A. from UCSD, served in the United State Marine Corps at Camp Pendleton and graduated from California Western School of Law in 1996.
